Terms of Use

1  Introduction

1.1  These terms and conditions ("Terms") govern your viewing and use of our Website, at mauritius-airport.atol.aero, which is owned and operated by Airport Terminal Operations Ltd (“ATOL”).

1.2  In the present Terms and Conditions of Use, “ATOL” shall include ATOL’s agent/s, sub-contractor/s, and/or service provider/s. For the purposes of these Terms "we", "our" and "us" refers to "ATOL".

1.3  Any reference made to the “Mauritius Airport” in these Terms hereafter means Sir Seewoosagur Ramgoolam Airport.

1.4  ATOL makes this Website available to you to provide information about its business, and the services available at Mauritius Airport.

1.5  Use of the Website  includes accessing and browsing this Website. Should you use one of the links in this Website  to visit one of our partner websites, your viewing and use of such partner websites including any transactions made through them shall not be governed by the present Terms. Inasmuch as ATOL has no control over such linked websites, ATOL shall not be responsible for their contents or any changes or updates therein. ATOL shall further not be responsible for webcasting or any other form of transmission received from any linked site.

1.6  You may only use this Website in accordance with these Terms and for lawful and proper purposes which includes complying with all applicable laws and regulations applicable in Mauritius or in any other jurisdiction from which you are accessing this Website.

1.7  Please read these Terms carefully before you start to use the Website. By accessing the Website you agree to the Terms. If you do not agree with these Terms, please do not access or use the Website.

2  Information on Flight Arrivals, Departures and Destinations

2.1  We endeavour to ensure that the flight information contained on the Website  is accurate and up to date.

2.2  With regard to flight arrivals and departures, please note that the flight arrivals and departures pages contain the scheduled arrival and departure times of most flights. We can only update the flight arrivals and departures pages once third parties have informed us that a particular flight is early, delayed, rescheduled or cancelled. Therefore we are not in a position to guarantee the accuracy of that information.

2.3  We always advise you to call the airline in advance if you have concerns that a particular flight may have been cancelled, rescheduled or seriously delayed.

2.4  With regard to flight destination information available on the Website, we do our best to ensure that this is accurate and up to date, but we are reliant on third parties advising us of any changes.

2.5 Flight schedules are not final and subject to day-to-day updates.  Please contact your airline for any future date schedule.

2.6  The Website is based on real-time information whose delivery is subject to the availability and operation of mobile networks, and as such no warranty or guarantee can be offered regarding its accuracy, completeness or timely delivery

3  Data Protection

3.1  By submitting your personal information to ATOL, you explicitly agree that this information, in accordance with the Mauritian Data Protection Act 2017, may be used by ATOL and trusted third parties in order to provide the Website and related services at Mauritius Airport. Any personal information you supply to us when you use this Website will be used in accordance with our Privacy Policy.

3.2  You acknowledge that any personal information you choose to provide is accurate.

4  Availability

4.1  ATOL will make reasonable efforts to keep the Website available at all times. However, you acknowledge that the Website is provided over the Internet and mobile networks and so the quality and availability of the Website may be affected by factors outside ATOL's reasonable control.

4.2  ATOL, its partners and subcontractors do not accept any responsibility whatsoever for unavailability of the Website, any difficulty or inability to download or access content or any other communication system failure which may result in the Website being unavailable.

4.3  In order to use the Website, you are required to have a compatible desktop or laptop computer, smartphone or handheld device, internet access, with the standard minimum specifications.

4.4  ATOL will not be responsible for any support or maintenance of your device for use of the Website. You will ensure that your device is compatible with the Website.

4.5  The Website may be upgraded to add support for new functions and services. 

4.6  ATOL reserves the right to change or suspend any aspect or feature of the Website at any time without notice and without liability. ATOL also reserves the right to impose limits on certain Website features or restrict access to parts or all of the Website without notice and without liability.

4.7  This Website is currently made available to you free of charge for your personal, non-commercial use. ATOL reserves the right to amend or withdraw the Website, or charge for the service provided to you in accordance with these terms and conditions, at any time and for any reason.

5  Your obligations when using the Website

5.1  You acknowledge that the terms of agreement with your respective mobile network provider will continue to apply when using the Website. As a result, you may be charged by the mobile network provider for access to network connection services for the duration of the connection while accessing the Website  or any such third party charges as may arise. You accept responsibility for any such charges that arise.

5.2  If you are not the bill payer for the mobile telephone or handheld device being used to access the Website, you will be assumed to have received permission from the bill payer for using the Website.

5.3  You may only view and use this Website in accordance with these Terms and, in any event, for lawful and proper purposes which includes complying with all applicable laws, regulations and codes of practice within Mauritius or other jurisdiction from which you are accessing this Website.

5.4  In particular, you agree that you will not:

5.4.1  post, transmit or disseminate any information on or via this Website which is or may be harmful, obscene, defamatory or otherwise illegal;

5.4.2  use this Website in a manner which causes or may cause an infringement of our rights or the rights of any other;

5.4.3  make any unauthorised, false or fraudulent booking;

5.4.4  use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of this Website including but not limited to uploading or making available files containing corrupt data or viruses via whatever means;

5.4.5  deface, alter or interfere with the front end 'look and feel' of this Website;

5.4.6  take any action that imposes an unreasonable or disproportionately large load on this Website or related infrastructure; and

5.4.7  obtain or attempt to obtain unauthorised access, via whatever means, to any of our networks.

5.5  You must not misuse this Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this Website, the server on which this Website is stored or any server, computer or database connected to this Website. You must not attack this Website via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identify to them. In the event of such a breach, your right to use this Website will cease immediately.

5.6  We reserve the right to suspend or terminate your access and use of this Website at any time if you breach these Terms.

6  Termination

6.1  ATOL may terminate use of the Website at any time by giving notice of termination.

6.2  Upon any termination, (a) the rights and licenses granted to you herein shall terminate (b) you must cease all use of the Website.

7  Limitation of Liability

7.1  In no event ATOL will be liable for any direct or indirect losses or damages of any kind arising out of your use or access to the Website, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.

7.2  ATOL is not liable for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the Website.

7.3  ATOL's liability will in any case be limited to the price paid (if any) for the service.

7.4  ATOL shall in any case have no liability to you if events beyond its control, such as internet connection, prevent it from providing the service (force majeure).

8  Disclaimer of Warranties

8.1  The Website is provided "as is" and "as available" without warranty of any kind.

8.2  ATOL makes every effort and takes all reasonable precautions to ensure that any content in this Website is relevant and useful. However, ATOL does not give any express or implied warranty as to its accuracy.

8.3  ATOL further makes every effort and takes all reasonable precautions to ensure that the Website is available at all times. However ATOL does not guarantee same, nor does it guarantee that they will always perform at a particular speed or with particular functionality. ATOL does not guarantee that this Website will operate free of error or defect or that they are free from computer viruses, malwares or any other contaminating and/or harmful computer software.

8.4  In as much as information transmitted via the Internet may be susceptible to monitoring and interception, you will bear all risk of transmitting information in such a manner. ATOL does not accept responsibility for, and therefore disclaims, any loss, prejudice or damage suffered by you as a result of transmitting information to ATOL. ATOL further reserves the right to request independent verification of any information transmitted via e-mail. You are informed that any unsolicited confidential or proprietary information sent to us via the Internet cannot be guaranteed to remain confidential. 

8.5  ATOL does not accept responsibility for, and therefore disclaims, any loss, prejudice or damage whatsoever with regard to customer data or other data directly or indirectly caused by malfunction of our system, third party systems, unlawful access to or theft of data, computer virus or destructive code on our system or third party systems such as telecommunication service providers, electricity suppliers, internet service providers or any event over which ATOL has no control. 

8.6  ATOL does not accept responsibility for, and therefore disclaims, any liability for errors, inaccuracy, omissions and for any loss, prejudice, or damage, of whatsoever nature and however arising, that you may suffer as a result of your using or inability to use this Website or any information/material contained therein. In particular, ATOL does not accept responsibility for, and therefore disclaims (a) any loss of profits, loss of earnings, loss of anticipated savings, loss of goodwill or loss of revenue; (b) any loss or corruption of data; or (c) any direct, indirect, special, incidental, consequential loss or punitive damages howsoever arising.

8.7  To the maximum extent permitted by law, all representations, warranties, terms, conditions and commitments not expressly set out in these Terms are hereby excluded.

9  Intellectual Property

9.1  All trademarks, service marks, copyright, database rights and other intellectual property rights of any nature in this Website or inherent in any material published therein, including the underlying software code, are the sole and exclusive property of ATOL or, where applicable, ATOL’s business partners and/or licensors.

9.2  You will not be allowed, nor allow third parties on your behalf, to make and distribute copies of the Website, attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, transfer, exchange or translate the Website or create derivative works of the Website of any kind whatsoever.

9.3  ATOL hereby grants you a worldwide, non-exclusive, revocable license to use the Website for your personal use in accordance with the Terms.

10  Amendments to the Terms

10.1  ATOL may, at any time and with notice, amend or update the Terms. Any such amendments/updates shall be effective immediately and you will be deemed to have acknowledged/accepted any such amendments/updates should you continue to use the Website thereafter.

10.2  Please check this page from time to time to take notice of any changes that may be made, as any changes will govern your viewing and use of the Website.

11  Jurisdiction

11.1  If you are a consumer, these Terms, its subject matter and its formation, are governed by Mauritian law. You and we both agree that the courts of Mauritius will have exclusive jurisdiction in all disputes arising under the present Terms.

11.2  If you are a business, these Terms, its subject matter and its formation (and any non-contractual disputes or claims) are governed in accordance with Mauritian law and we both agree to the exclusive jurisdiction of the courts of Mauritius.

12  Corporate Information

12.1  AIRPORT TERMINAL OPERATIONS LTD is a private company incorporated under the Laws of the Republic of Mauritius, registered under the Business Registration Number C082342 and having its registered office situated at Sir Seewoosagur Ramgoolam International Airport, Plaine Magnien, Republic of Mauritius.
